§ 5(b) tolling (face-of-complaint rule)

consideration of the applicability of § 5(b) must be limited to a comparison of the two complaints on their face. Obviously suspension of the running of the statute of limitations pending resolution of the government action may not be made to turn on whether the United States is successful in proving the allegations of its complaint.
